NCH vs Consumer Court: Where Should You File a Consumer Complaint in India?

Short answer: For most everyday disputes, the National Consumer Helpline (NCH) is the practical first step. It is a pre-litigation mechanism: you register a grievance, receive a docket number, and the grievance is forwarded to the company, which is expected to respond in about 30 days. It costs nothing, but registration does not guarantee a remedy. A Consumer Commission (consumer court) is the next step when the company ignores you or the loss is significant, because only a Commission can pass a binding, enforceable order.
What the National Consumer Helpline actually does
The NCH is run by the Department of Consumer Affairs and is designed as a pre-litigation channel. When you register a grievance, you get a docket number that lets you track the grievance. The grievance is then forwarded to the company concerned, and the process runs for up to about 30 days.
Under the NCH Convergence Program, participating companies join voluntarily. Their grievances are forwarded in real time and they are expected to respond within 30 days. That voluntary nature is the key limitation: NCH facilitates a response, it does not adjudicate. The helpline states expressly that registration of a grievance does not guarantee a remedy.

What a Consumer Commission (consumer court) does
A Consumer Commission is a quasi-judicial body under the Consumer Protection Act, 2019. Unlike NCH, it hears both sides and passes an order that binds the seller or service provider. It can direct a refund, replacement, removal of a deficiency, and compensation for loss or harassment.
Filing is available online through e-Jagriti. The filing fee is currently nil where the consideration paid is up to Rs 5 lakh, which removes the most common reason people avoid the Commission route.
Which Commission you approach depends on the value paid as consideration, per the Government's 2021 notification: District Commission up to Rs 50 lakh, State Commission above Rs 50 lakh and up to Rs 2 crore, and National Commission above Rs 2 crore.

When NCH is the right choice
- The amount is modest and you mainly want the money back
- The company has an escalation team but support has gone silent
- You want a documented, trackable record before escalating
- You want a resolution attempt without cost or legal process
When to go to a Consumer Commission
- The company did not respond within about 30 days, or refused unreasonably
- The financial loss is significant
- You are also claiming compensation for harassment or consequential loss
- You need an order that can actually be enforced

The practical sequence
Start with the company's own escalation channel. If that fails, register an NCH grievance and keep the docket number. If there is no meaningful response in about 30 days, or the loss is large enough to justify it, move to the appropriate Consumer Commission.
